Please read these Terms of Service before using the Owl Listen App, official website, or related services. These terms constitute an agreement between you and the Owl Listen Team ("we", "us", or "our"). If you do not agree to these terms, please stop using the service.
1. Service Description
Owl Listen is an AI intensive listening tool designed for foreign language study, providing audio import, playback, speech-to-text recognition, AI sentence splitting, translation, and review assistance. We focus on compatibility, recognition quality, playback experience, and learning efficiency. We do not provide official language courses or guarantees of learning outcomes.
2. Eligibility and Region
This service is intended for users who have legal capacity. If laws in your jurisdiction require parent or guardian consent, you must obtain such consent before using the service. You agree to comply with applicable local laws, Apple App Store rules, and these Terms.
3. Accounts, Devices, and Security
Certain features may require an account, device permissions, internet access, or an Apple App Store account. You are responsible for ensuring provided information is accurate and for securing your device and credentials. Loss resulting from failure to secure your device or account is your responsibility, except as otherwise provided by law.
4. User Content and License
Audio, text, links, subtitles, translation requests, and study logs you import or submit belong to your "User Content". You warrant that you have lawful rights to process such content without violating third-party copyrights, privacy, publicity, trade secrets, or legal rights.
To deliver recognition, sentence splitting, translation, playback, caching, review, and support features, you grant us and necessary service providers a limited, non-exclusive, worldwide license to process your content. This license is used strictly to operate and improve Owl Listen, and never for advertising or unrelated data analysis.
5. AI and Cloud Processing
Owl Listen combines local and cloud capabilities. File import, playback, caching, and preprocessing run locally. High-precision text recognition, sentence splitting, or translation requests are sent via encrypted connections to cloud AI models or infrastructure.
AI-generated recognition, splitting, and translation results may contain errors or inaccuracies. Use these results solely as a learning aid, not as the sole basis for professional translation, official examination scoring, legal, medical, or financial matters.
6. Subscriptions, Purchases, and Refunds
If Owl Listen offers Plus subscriptions, one-time purchases, or other paid features, specific pricing, trial terms, auto-renewal, and cancellation rules are displayed in the App and Apple App Store. Payments, taxes, billing, cancellations, and refunds are managed directly by Apple. You may cancel auto-renewal in your Apple ID settings.
Monthly AI credits included with subscription plans reset at the end of each billing cycle and do not roll over. Separately purchased Credit top-up packs remain valid until service termination or account closure.
7. Acceptable Use
You may not use Owl Listen to engage in unlawful, infringing, fraudulent, abusive, or disruptive activities, or to bypass usage limits. Reverse engineering, API scraping, uploading malicious files, or processing content that violates third-party rights is strictly prohibited.
8. Intellectual Property
Owl Listen's software, interface, icons, branding, text, design, and technical assets are owned by us or our licensors. Except as explicitly allowed by these Terms, you may not copy, modify, distribute, sell, lease, or reverse engineer any part of Owl Listen. You retain your rights in your User Content.
9. Third-Party Services
Owl Listen relies on third-party infrastructure including the Apple App Store, cloud hosting, AI model APIs, and diagnostic services. Third-party services are subject to their own terms and privacy policies.
10. Service Modifications and Termination
We may adjust, suspend, or discontinue features due to technical, operational, compliance, or security reasons. For material changes or permanent service discontinuation, we will provide at least 30 days' advance notice via reasonable channels. In the event of service termination, unused purchased Credit top-up packs will be subject to a refund or settlement plan as detailed in the termination announcement.
11. Disclaimer of Warranties
To the maximum extent permitted by law, Owl Listen is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of uninterrupted operation or total accuracy. You should back up your important materials independently.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, study delays, or lost profits.
13. Local Consumer Rights
These terms do not restrict non-waivable statutory rights granted to consumers under local laws.
14. Termination
You may stop using Owl Listen at any time. We may suspend or terminate access if you violate these Terms or security policies.
15. Updates to Terms
We may update these Terms from time to time. Continued use of the service after updates constitutes acceptance of the updated terms.
